1. Introduction and acceptance of terms

These Terms of Service ("Terms") govern the use of the services offered by Alpine Pathways Austria, Schönbrunner Straße 221, 1120 Wien, Austria, email: [email protected], phone: +43 1 587 24 68 ("we", "us", "our", or the "Service Provider"). By booking, purchasing, participating in, or otherwise using any of our services, you ("Customer", "you", or "participant") agree to be bound by these Terms.

If you do not agree with these Terms, you must not book or participate in our services. These Terms apply to all services provided by Alpine Pathways Austria, including guided alpine day hikes, multi-day hiking tours, private hiking excursions, family-friendly nature walks, and sunrise and sunset mountain hikes.

Where applicable, mandatory consumer protection provisions under Austrian law and European Union law remain unaffected by these Terms.

2. Scope of services

Alpine Pathways Austria provides hiking and nature-based outdoor experiences, which may include, depending on the selected service:

Service details, including duration, meeting point, difficulty level, required equipment, group size, and price, are set out in the respective booking offer, website description, or written confirmation. We reserve the right to adapt routes, schedules, and meeting points due to weather, trail conditions, safety considerations, official restrictions, or the fitness and experience level of participants.

Unless expressly agreed otherwise in writing, our services are recreational outdoor activities and do not constitute mountaineering instruction, rescue services, medical services, or transport services.

3. User obligations and responsibilities

You are responsible for ensuring that you are physically and mentally fit to participate in the booked activity. You must inform us before booking and again before the start of the activity about any relevant health conditions, allergies, injuries, pregnancy, mobility limitations, medication, fear of heights, or other circumstances that may affect your participation or safety.

We may exclude a participant from an activity, in whole or in part, if the participant does not meet safety requirements, fails to follow instructions, or behaves in a way that endangers themselves, other participants, staff, or third parties. In such cases, any refund shall be determined in accordance with Section 5 and applicable law.

4. Payment terms and conditions

Prices are stated in euros unless otherwise indicated and include only those services expressly listed in the booking confirmation. Any additional costs, such as travel to the meeting point, accommodation, meals, lift tickets, public transport, parking, or personal equipment, are borne by the Customer unless expressly included in the offer.

Payment is due according to the payment method and deadline stated during booking or in the invoice. We may require advance payment, a deposit, or full prepayment to confirm a booking. A booking is only binding once it has been confirmed by us in writing or electronically and, where applicable, the required payment has been received.

If payment is not received by the due date, we reserve the right to cancel the booking and make the place available to other customers. Any bank charges, chargeback fees, or costs arising from failed payment attempts may be charged to the Customer to the extent permitted by law.

We may adjust prices before booking confirmation to reflect changes in taxes, fees, or significant cost increases. Confirmed bookings are subject to the price agreed at the time of confirmation, unless mandatory legal provisions require otherwise.

5. Cancellation and refund policy

Cancellations by the Customer must be communicated to us in writing by email to [email protected]. The applicable cancellation terms depend on the type of service, the timing of cancellation, and any specific conditions stated in the booking confirmation.

If a participant fails to appear at the agreed time and place, or is excluded from participation due to a breach of these Terms or safety requirements, no refund is owed unless mandatory law provides otherwise.

We may cancel or postpone an activity due to weather, unsafe conditions, insufficient participant numbers, official orders, or other operational or safety reasons. In such cases, we will, at our discretion and subject to applicable law, offer either:

For consumer bookings made at a distance, any statutory right of withdrawal under Austrian and EU law may apply only where no legal exception exists. In particular, the right of withdrawal may not apply to leisure services scheduled for a specific date or period, where the relevant legal conditions are met.

6. Liability limitations

Participation in hiking and mountain activities involves inherent risks, including but not limited to slips, falls, weather changes, terrain hazards, altitude effects, wildlife encounters, and accidents caused by third parties or natural conditions. By participating, you acknowledge these risks and agree to act prudently and follow all safety instructions.

We shall be liable in accordance with mandatory Austrian law. Nothing in these Terms excludes or limits liability for intent, gross negligence, personal injury, or any liability that cannot be excluded under applicable law.

To the extent permitted by law, Alpine Pathways Austria shall not be liable for:

Where we rely on third-party providers, such as transport, accommodation, or lift operators, we are not responsible for their independent services unless mandatory law provides otherwise. Any claims against such third parties remain subject to their own terms and conditions.

Participants are responsible for obtaining appropriate travel, accident, health, and cancellation insurance where desired or necessary. We strongly recommend insurance coverage suitable for alpine and outdoor activities.

7. Intellectual property rights

All content provided by Alpine Pathways Austria, including but not limited to text, photographs, logos, route descriptions, maps, training materials, branding, website content, and documents, is protected by applicable intellectual property laws and remains our property or the property of our licensors.

You may use our materials only for personal, non-commercial purposes related to the booked service. Any reproduction, distribution, public display, modification, or commercial use without our prior written consent is prohibited, except where mandatory law allows otherwise.

If you submit reviews, photos, or other content to us, you grant us a non-exclusive, royalty-free, worldwide license to use such content for marketing, informational, and operational purposes, unless you object in writing or the content includes personal data subject to separate consent requirements.

8. Data protection and privacy

We process personal data in accordance with the General Data Protection Regulation (GDPR), the Austrian Data Protection Act, and other applicable privacy laws. Personal data collected in connection with bookings and service delivery may include name, contact details, payment information, emergency contact details, health-related information voluntarily provided for safety purposes, and participation-related information.

9. Force majeure

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to extreme weather, avalanches, landslides, natural disasters, fire, epidemic or pandemic events, official orders, trail closures, strikes, transport disruptions, power outages, or other unforeseeable events ("Force Majeure").

In the event of Force Majeure, we may suspend, modify, postpone, or cancel the affected service. Where reasonably possible, we will offer an alternative date or substitute arrangement. Any refund or compensation shall be determined in accordance with applicable law and the specific circumstances of the case.

10. Changes to terms

We may amend these Terms from time to time to reflect changes in law, operational requirements, or service offerings. The version of the Terms in force at the time of booking shall apply to that booking, unless a change is required by mandatory law or expressly agreed otherwise.

Updated Terms will be published or otherwise communicated in a reasonable manner. Continued use of our services after the effective date of revised Terms constitutes acceptance of the updated Terms to the extent permitted by law.

11. Applicable law and jurisdiction

These Terms and any contractual or non-contractual obligations arising out of or in connection with them shall be governed by the laws of Austria, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods, to the extent legally applicable.

For disputes with consumers, the statutory place of jurisdiction and mandatory consumer protection rules shall apply. For business customers, the exclusive place of jurisdiction, to the extent legally permissible, shall be Vienna, Austria.

13. Severability clause

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid provision that most closely reflects the original commercial intent and legal purpose, to the extent permitted by law.

Any failure by us to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
